Area of validity

These general terms and conditions of the Museen der Stadt Wien (in the following referred to as WIEN MUSEUM) apply to the order of goods from the range offered by the WIEN MUSEUM in its Online Shop in the version valid at the time when the order is made.

By making an order the client accepts the general terms and conditions. Only these terms and conditions are valid. Deviant conditions will not be recognised by the WIEN MUSEUM unless the WIEN MUSEUM has expressly accepted the deviation in writing.

If separate conditions of these general terms and conditions contradict compulsory legal regulations completely or partially, the remaining terms of these general terms and conditions nevertheless retain their validity.

Language of the contract

The language of the contract is English.

Products on offer and contractual relationship

If you support our project with an amount of money in the online shop, then the legally valid donation of this amount takes place with the click on "PAY" in the payment window of the mPAY24 GmbH.

We accept your donation immediately after the clicking on "PAY"

Donation

Since the range of items in the online shop is solely donations, it will be charged without sales tax.

If the WIEN MUSEUM is unable to accept the order or cannot carry it out because the item is not available, the client will be informed immediately via E-mail. Payments that have already been made will be reimbursed.

Possibilities and conditions of payment

Payment is made by credit card (Mastercard, Visa) or by electronic transfer.

The payment options offered in our Online Shop are handled safely and reliably by means of the certified and excellent Payment Service Provider (PSP) mPAY24 Ltd.

Warranty conditions and compensation

The legal terms of warranty and guarantee are applicable.

Right of withdrawal

The client can withdraw from the contract without stating reasons within 14 days after receiving the ordered good(s) according to the conditions laid down in the Austrian Distance and Off-Premises Contracts Act (FAGG) unless one of the exceptions from the right of withdrawal according to § 18 FAGG is applicable.

Instruction on the right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

To exercise the right of withdrawal, you must inform us (WIEN MUSEUM, Museen der Stadt Wien, Karlsplatz 8, 1040 Wien, TEL +43-1-505 87 47, FAX: +43-1-505 87 47-7201, office@wienmuseum.at) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Information about donations

All contributions are tax-deductible to the fullest extent allowable by law. Donations to the WIEN MUSEUM are fully tax deductible in Austria. If you are living in the US, you could route your donation through our Chicago based office of “American Friends of the Vienna Museum”. Please contact us directly for further information.

According to the new donation deductibility regulation (effective from 01.01.2017), donors can no longer plead their donations as special expenses themselves, but the organizations that are the beneficiaries of the donation forward the information of the donation in encrypted form to the tax authorities after successful payment process. To do so they must have the necessary data - the full name and date of birth as they appear in the registration register). WIEN MUSEUM is a donation-favored institution (registration number list of favored institutions: MÖ-4438).

The information needed for the transfer to the tax authorities can be entered by the donor during the purchase on the website. Entering this information for individuals is optional. Companies receive an invoice and donation receipt from the Wien Museum after successful payment, in order to report the donation to the tax authorities themselves and to plead it as an operating expense.

Final provisions

Austrian law is applicable.

Vienna is the place of fulfilment.

It is agreed that the place of jurisdiction is the objectively relevant court in Vienna. If the client is a consumer in the sense of the Consumer Protection Law, then the court is objectively competent in the district where the client has his/her place of residence, the usual place of abode or place of employment.

If necessary the WIEN MUSEUM reserves the right to make adjustments and changes to the general business conditions.
